Court adjudicates Joshua Alcarez, sentences him to three years in custody

The court found Joshua John Alcarez in violation of a condition of his deferred adjudication and adjudicated him guilty, revoked his community supervision and sentenced him to three years in the Texas Department of Criminal Justice.

At the hearing Alcarez pleaded true to a violation of condition number 4, admitting he failed to report as directed for specified months. The state told the court it would move to adjudicate; the parties presented a proposed agreement in which the state sought a three-year term in state custody. The judge asked Alcarez whether he understood the consequences of pleading true and whether he waived his right to appeal; Alcarez confirmed he did.

The court followed the parties’ agreement, revoked community supervision, entered a finding of guilt and imposed a three-year sentence to the Texas Department of Criminal Justice, giving credit for any time already served. The judge recommended placement in a therapeutic community program and explained that recommendations for earning time credits are controlled by the sheriff or department policies, not the court. The judge also reminded Alcarez that, because this is a felony conviction, he is prohibited from possessing weapons or ammunition.

The courtroom exchange included admonitions from the judge about the obligations of probation and the importance of reporting to probation officers; Alcarez said he had been working through Job Corps and had housing arrangements. The defendant waived his right to appeal as part of the plea proceedings.
