The Morgan County Planning Commission voted unanimously Thursday to forward a positive recommendation to the county commission for rezone application 25.02, which would change a 21.64‑acre parcel in the Rindell’s Box Subdivision from Agricultural 20 (A‑20) to Ranch Residential 5 (RR‑5).
The staff presentation identified the parcel as currently split between agriculture and Ranch Residential 5 on the county’s future land use map and recommended findings that the rezone “is consistent with the county’s future land use goals,” is in harmony with nearby land uses and property sizes, and is not expected to adversely affect adjacent properties. Planning staff stated the application meets the requirements for a legislative rezone.
The recommendation matters because it advances the proposal to the Morgan County Commission for a final decision; a planning commission recommendation does not itself change zoning. Approval by the county commission would alter the minimum lot size and subdivision standards that apply to the property and could enable a future subdivision under RR‑5 rules.
At the hearing, commissioners and staff discussed access and frontage requirements that would apply if the parcel is later subdivided. Planning staff explained that access and frontage are reviewed at the subdivision stage, not during the legislative rezone. Staff said that the RR‑5 district requires 250 feet of frontage for lots and that the existing lot currently uses an access easement suited to A‑20 but that frontage for new RR‑5 lots would likely require constructing a street or creating a compliant private lane at subdivision.
The applicant’s representative, Steve Wynn, told the commission the applicants plan to create a private lane that would be extended and split to provide frontage for two new lots and noted that a private lane can serve up to four homes under current county practice. “Our plan currently is to create a private lane that would come up into here, split out so that we can make the frontage for the two lots that we're planning on doing,” Wynn said.
Member Wilson moved to forward a positive recommendation to the county commission for rezone application 25.02, changing 21.64 acres from A‑20 to RR‑5 and updating the future land use map accordingly; Member Sessions seconded the motion. The commission voted unanimously in favor.
The planning commission also closed the public hearing on the item after receiving no public comments and approved minutes from its June 26, 2025 meeting by unanimous vote. The county commission will consider the rezone in a later public meeting.
Next steps: the rezone recommendation will be scheduled before the Morgan County Commission for final action; if the commission approves the rezoning, the applicant would still need to pursue subdivision approvals to create buildable RR‑5 lots.
