The Lemoore City Council approved an assignment-and-assumption agreement allowing Farm Lemoore to transfer its obligations under an existing development agreement to Air Ag LLC, while keeping the original developer obligated to the city.
City staff explained the document follows procedures already provided for in the development agreement. The city attorney said the assignment does not change the underlying terms and that both parties remain obligated to fulfill the development agreement’s requirements.
Council member Gornick asked whether the transfer related to ongoing operations; staff said they did not know the private parties’ rationale but indicated Farm Lemoore had not operated at the site and that Air Ag would lease the space and assume obligations if the assignment was approved. “The terms are not changing,” staff said, noting the assignee would be bound by the same development-agreement requirements.
Council moved and approved the item on the consent calendar by roll-call vote. The motion passed 5–0 with Council member Gornick, Council member Brewster, Council member Lyons, Council member Cruz and Mayor Matthews recorded in favor.
The item was approved as an administrative consent item; no additional conditions were imposed at the meeting.
