Board tables bus stop-arm camera enforcement proposal to August after legal and fairness concerns

The board voted July 14 to table a proposal that would authorize the Cornwall Central School District to participate in a bus stop-arm camera enforcement program administered by a private vendor commonly known as BusPatrol. Board member Christian Brunelli urged the delay and raised legal and equity concerns, saying litigation in New York earlier this decade showed high overturn rates and that some programs place the burden of proof on the driver. Brunelli also noted revenue-sharing arrangements mentioned in the discussion and said fines would disproportionately fall on district residents. Interim Superintendent Megan Argenio and John Fink, the district clerk, said several neighboring districts have adopted camera enforcement and that cameras already are installed on some buses; however, use of images to issue civil penalties requires local board authorization. Fink said the county would provide digital mapping tied to the program if the board participates. After discussion, a motion to table the item until the August meeting passed; trustees said additional research, legal review and community information would be appropriate before authorizing civil enforcement. Administration confirmed the cameras’ physical installation can exist without the board enabling civil notices; the board’s action controls whether images are used to issue fines.
