Commission authorizes emergency access agreement for South Fork Acres subdivision

Andrew Schrank of Highlands Engineering presented an emergency access agreement for South Fork Acres subdivision that requires private lot owners to maintain a shared access road to a standard that permits emergency‑vehicle access.
Schrank said the development was originally two parcels that the owner proposes to split into eight lots, increasing traffic across a private access easement. He told Commissioners the city raised concerns about enforceability of private covenants and the risk to emergency responders. "We drafted an emergency access agreement that basically states these owners have to maintain this road to a level that will allow for fire truck and emergency vehicle access through this development," Schrank said.
Under the draft agreement, the county would notify lot owners if the road is insufficient, allow a reasonable repair period, and — if owners do not complete repairs — the county may perform the work and charge the lot owners. Schrank noted the county and emergency management should set a maximum vehicle weight and axle limits for access; commissioners directed staff to coordinate with emergency management and roads to finalize those figures.
Commissioner White moved to authorize execution of the emergency access agreement, amended to allow legal review by County Attorney Amanda (last name not specified); the motion passed unanimously.
