Williams County commissioners approved a three-lot minor subdivision for a 22-acre parcel in Stoney Creek Township despite a denial recommendation from the township, following a 5–0 recommendation for approval from the Planning and Zoning Commission.
County planning staff said the applicants—trustee Richard Huebner, Roger Huebner, Ronald Huebner and Rosemary Berg—seek to divide the parent parcel into three lots of approximately 5.53 acres, 8.12 acres and 8.1 acres. Staff said all three lots meet the minimum acreage for the rural residential zoning district; the smallest lot's size is limited by the presence of 150 Third Lane NW which separates it from the remainder of the parcel.
Staff explained that minor subdivisions like this are usually completed administratively, but the township's recommendation of denial invoked a public hearing per chapter 4-5-3.6 of the Williams County zoning ordinance and subdivision regulations; the Planning and Zoning Commission nevertheless recommended approval 5–0 on June 17. During the board meeting a commissioner asked why the township denied the application and staff replied the township follows an unwritten ten‑acre preference. The board moved, seconded and approved the subdivision by roll call; no amendments were recorded at the meeting.
Staff said recordation of the plat will be contingent on county departmental review. No additional conditions were added during the commission's approval.
