Plan Commission recommends accepting stormwater easement for Lake Benoires area

Plan Commission members reviewed and recommended approval of a proposed municipal stormwater easement for property southwest of 2022 Olivia Road adjacent to Phase 2 of the Lake Benoires multifamily development. The owner is Red Earth LLC and the applicant is the City of Oshkosh Department of Public Works.
Staff explained the easement is intended to make the pond and associated stormwater infrastructure part of Red Earth's public stormwater management system and to allow stormwater originating in the public right-of-way and areas outside Red Earth's property to drain through the pond. The easement permits city access for inspection to ensure the pond functions as designed, and staff said city attorney staff drafted the easement language and that Red Earth has agreed to grant the easement. Final signed easement documents will be recorded at the Winnebago County Register of Deeds after common-council approval.
There were no public speakers on the item. The motion to adopt the staff findings and recommendations carried on a roll-call vote with all commissioners present recorded as Aye: Miss Davey, Mister Lowenstein, Mister Bowen, Miss Sherman, Miss Prahm, Council Member Bulow, Mister Rucker, Vice Chair Keefer and Chairman Perry. The staff recommendation was adopted; recording shows the vote carried 9-0.
