The Plan Commission on July 15 approved a variance allowing the replacement of a flat roof with a pitched roof at 1301 West Fifth Avenue, after the owner had already replaced the roof citing leak and structural concerns. Viola Properties LLC is listed as owner and applicant. Staff recommended approval and described the change as compatible with nearby homes.
Staff reported that the applicant removed the flat roof before filing after a miscommunication with the contractor and urgent weather and leak concerns; staff said the new 4:12 pitch roof increased building height beyond the former ridgeline but did not negatively affect neighborhood character. "The applicant stated that the roof modifications were necessary because the flat roof was leaking and putting the well-being of the house in structural jeopardy," the staff presenter said.
Commissioners approved the variance unanimously but several expressed disappointment that the work was completed before the permit process. Council Member Bulow and Commissioner Davey both said they would have supported approval but would have preferred the work to go through the process first. The roll-call vote was recorded as unanimous: Miss Davey (Aye), Mister Lowenstein (Aye), Mister Bowen (Aye), Miss Sherman (Aye), Miss Prahm (Aye), Council Member Bulow (Aye), Mister Rucker (Aye), Vice Chair Keefer (Aye), Chairman Perry (Aye). Motion carried 9-0.
Staff included the usual conditions recorded in the staff report; no public comment was made on the item.
