Council moves to remove ADA-specific language from pier/launching-ramps bill after Critical Area Commission input

A revision to a recently passed bill concerning community piers and launching ramps will remove a section regarding ADA improvements after the county’s planning staff and the Critical Area Commission raised concerns that the language could limit local discretion. Councilmember Fiedler said the Critical Area Commission and the Office of Planning and Zoning recommended removing the ADA-specific section because “the section regarding ADA improvements may limit OPZ’s ability to limit any activity in the critical area,” and keeping the provision would hold up the remainder of the bill. Lynn Miller of Planning and Zoning said county code already contains a reasonable-accommodation provision (cited as section 18-13-1105) that grants the county flexibility to accommodate disability requirements. The administration supported removing the provision at the commission’s recommendation; no vote was taken during the work session. Councilmembers said they would proceed with the removal to allow the bill to move forward, noting the county’s existing code provides accommodation authority while preserving Critical Area oversight.
