The East Troy Plan Commission on June 9 recommended that the village board approve a certified survey map (CSM) for property on Town Line Road filed as PA 132000001 by applicants Carl Wolf Jr. and Becky A. Wolf, subject to standard staff conditions and payment of fees. The recommendation carried with one abstention.
Planning staff said the property lies in the town and therefore falls under the village's extraterritorial plat-review jurisdiction; staff cited the village code provision that defines the scope of extraterritorial review and warned the village cannot enforce its zoning density or land-use rules on properties in the town under that jurisdiction. Staff reported the subject land is zoned C-2 and meets parcel size, area, and width requirements but noted two proposed lots on the north end have an elongated depth-to-width ratio that the town and Walworth County should examine.
Staff recommended approval subject to the usual conditions and any comments from staff, the Plan Commission, and payment of fees. The town has already approved the CSM, staff said. A commissioner moved to recommend the CSM to the village board with two conditions; another commissioner seconded, and the motion passed with one abstention.
The commission's recommendation preserves the village's ability to comment under extraterritorial plat review while leaving final approval and any zoning determinations to the town and county as applicable.
