Council declares fire-damaged garage at 1407 Fourth Avenue North a hazardous building and authorizes abatement

The Moorhead City Council on July 14 approved two resolutions declaring a fire-damaged garage at 1407 Fourth Avenue North a hazardous building and authorizing the agreements necessary for abatement and demolition if the owner or estate does not repair or remove the structure.
Chrissy Leshzewski, community development director, told the council the garage was a total loss after an August fire. Letters requesting repair or removal were sent to the property owner, who, according to a Minnesota Department of Health notice cited by staff, passed away in December. Notices were also sent to the owner's estate and staff placed photos and a report in the council packet.
Leshzewski said staff recommended (1) a resolution declaring the structure hazardous under Minnesota statute 463 and ordering repair or removal, and (2) a resolution authorizing agreements necessary for abatement and demolition of hazardous conditions. She said, if adopted, staff would issue required published notices and then request a court order to remove the hazardous structure; if the court authorized demolition, demolition costs would be assessed to the property.
The council opened and closed the public hearing on the item with no public comment, and then approved the two resolutions.
Staff said the city would proceed with required notices and, if needed, seek a court order to remove the structure and assess costs to the property or estate.
