Board renews interim-use permit for Northwest Excavating after ownership change

Clay County planning commissioners voted to approve a renewal of an interim-use permit (IUP) for a gravel-mining operation previously permitted in 2024. The renewal stems from a recent ownership change; county policy requires reauthorization of an IUP when property ownership changes.
Planning staff said the site was inspected in May and found generally in compliance, with only a few minor notes to address. The IUP will be renewed with the same conditions as the earlier permit; staff noted the county’s updated ordinance requires revised findings of fact and that the new permit term extends to 2035 to reflect the reissued authorization.
The board required that the standard permit conditions be met and that items noted in the May inspection be addressed. Staff described the conditions as consistent with the permit issued in 2024 and said the renewal does not follow from any violations; rather, it is an administrative step tied to transfer of ownership.
No members of the public spoke for or against the renewal. The motion to approve the IUP with the existing 14 conditions was made by Ashley and seconded by Laura; the chair announced the motion carried by voice vote.
