A judge in the 252nd District Court ordered that Carly Davis obtain and wear a court-approved drug-monitoring patch after a pretrial test returned positive for THC, amphetamines and benzodiazepines.
The court told Davis the result raised concern because the probable cause affidavit alleged marijuana was found in her vehicle and she was awaiting trial on a third-degree DWI charge that included prior convictions. The judge set a strict condition: Davis must get a drug patch within 24 hours, show proof to her bondsman and counsel, and provide any prescriptions and pharmacy printouts that would explain positive results for benzodiazepines.
“If you have a prescription that’s gonna make you test positive for benzodiazepine or something like that, I want you to bring the prescription,” the judge said, directing Davis to the prosecutor’s office and her bondsman to get further instructions about obtaining the device. The judge warned that failure to be clean by the next court date could be a bond violation and result in remand to custody.
The court deleted a prior rejection entry for testing and gave Davis an additional reset to confirm compliance before moving the case to trial. The judge also told Davis to provide proof of the patch installation to her bondsman by the following day.
