The magistrate found that the property at 925 Cleveland Street in Titusville remained out of compliance because multiple windows were damaged or boarded, and imposed a fine of $100 per day commencing July 12, 2025, until the violations are corrected. The magistrate noted prior continuances but determined the condition was unchanged from the last review.
Robert C. Kirk (appearing at the hearing) told the magistrate he has been ill and is attempting to sell the property; he said a buyer plans to renovate and he expected work to start within 30–40 days. Kirk said he and his contractor had reduced the asking price to facilitate a sale and claimed progress in discussions with buyers. “I was kind of wishy washy there. And, so, you know, that’s where we're at,” Kirk said in explaining delays.
Officer Fry (code enforcement) presented photographs taken July 11 showing multiple windows still boarded and damaged and stated no permits for window replacement were in the building department file. The magistrate accepted the evidence, found notice had been properly provided, and imposed the $100-per-day fine starting July 12. The magistrate recorded $216.58 in administrative costs unpaid and said a certified copy of the order will be recorded in public records as a lien. The magistrate advised Kirk that if the windows are repaired and he notifies code enforcement, an inspection would verify compliance and stop the fines.
