The Brightwater Beach Condominium Association told the magistrate it has applied for after‑the‑fact permits for a newly erected dumpster enclosure and fence at 50 Fifth Avenue and is awaiting an amended site survey. The magistrate granted 60 days from the date of the order for the association to secure the required permits for both the fence and the dumpster enclosure.
Scott Vigneri, the community’s property manager, and board member Brandon Kaye told the court they were waiting on a site‑survey amendment; Matthew Ryan, present as the party who will manage permitting, said survey timing could be three to four weeks and asked for at least 60 days. The city’s code officer confirmed there had been prior work without permits, including a 2024 enclosure that was not permitted and later voided permitting activity.
The magistrate ordered the association to secure the after‑the‑fact permits within 60 days and warned against additional unpermitted construction; if permits are not secured the matter will return to the commission’s hearing calendar (the magistrate noted an October 13 hearing date as a likely reconvening point).
