ZBA asks city for site-plan records for 13 Mile and Mound flower/seasonal sales after enforcement concerns

The Warren City Zoning Board of Appeals voted to request copies of the site plan and related materials for the business operating at 13 Mile and Mound (a flower/seasonal-sales operation) to clarify permitted permanent and temporary uses and to support board-level review and code-enforcement follow-up.

Board members said they have observed multiple changes in how the property has been used, that temporary and permanent outdoor sales have shifted locations over time, and that the presence of seasonal tents and temporary signs has raised neighbor complaints. One board member said he wanted to make the request as a board rather than as an individual to avoid the appearance of a vendetta and to ensure transparency.

Discussion included whether the board has authority to request archived or currently filed planning documents and whether disclosure is permissible; the city attorney and staff said the request could be made and reviewed for permissible disclosure. The motion passed unanimously, subject to permissible disclosure.

Board members also discussed public-safety oversight for fireworks tents and noted that fire-department inspection is required for those temporary operations; they asked for clarity about whether the propertys permanent outdoor-sales approvals applied to the current location of tents and stands.

What happens next: Staff will determine what site-plan materials the city can provide for board review and return with documents or a legal determination about disclosure.
