Worcester — The applicant for a dimensional special permit to enlarge an accessory dwelling unit at 9 Hadwin Lane withdrew the application without prejudice on Wednesday after a contentious public hearing that drew several neighboring homeowners.
Attorney O’Neil presented the request for an ADU that would exceed the local 900‑square‑foot and 20‑foot height limits. Planning staff explained that state ADU law reconciliation is pending and that height allowances may change in coming months; staff noted the applicant seeks relief for a roughly 380‑square‑foot increase and a height increase of about 3.5 feet.
More than a half dozen neighbors spoke in opposition. Speakers raised concerns the proposed ADU would block light and airflow to adjacent yards, worsen parking and traffic on narrow local streets, and alter the single‑family character of the neighborhood. Several neighbors also said they were not notified directly of the hearing until after they bought or moved to nearby properties and questioned the applicant’s prior property maintenance and survey activities.
Board members were split: some said the modest height increase would be permitted under forthcoming state ADU revisions and were inclined to approve the dimensional relief; others argued the additional square footage went beyond the spirit of the ADU rules and feared a precedent. The applicant asked to withdraw the application without prejudice; the board granted the request 5-0.
Withdrawing without prejudice preserves the applicant’s option to refile in the future and allows time for applicants and staff to reconcile local requirements with the state ADU law updates. The hearing record remains available for any future applications.
