The Greenwood Stormwater Board granted a drainage-waiver July 9 for work at April Drive that previously was planned as part of a larger master plan, the board found.
Staff explained the waiver request under Greenwood municipal code and the Greenwood Stormwater Technical Standards Manual: the city’s rule requires two best-management-practice structures in series for developments that disturb at least 1 acre (Greenwood Municipal Code section 9-158(d) and Chapter 9(b) of the stormwater technical standards). Staff said the April Drive project as constructed disturbed about 0.8 acres; the additional disturbance shown on the master plan was associated with future development that would be required to provide its own outfall and water-quality control.
A staff representative said the originally proposed second BMP was not installed and that, as built, the project does not include the required cell associated with the standard manual. Staff recommended granting the waiver but requested conditions: specifically, update the operation and maintenance (O&M) manual and record the as-built documentation.
A motion was made to grant the request of Kimberly Horn on behalf of Greenwood Village South for a waiver from Greenwood Municipal Code section 9-158(d) and the stormwater technical standards manual Chapter 9(b) to allow a single BMP rather than two in series, finding the applicant met criteria set by Greenwood Municipal Code section 9-162(c). The motion included the condition to update the O&M manual and to record the as-built documents. The board adopted the motion by voice vote; all present board members said "aye." Staff noted that a written notice of decision will be provided following the board’s action.
Board discussion clarified that future development in the master plan area will be required to provide separate outfalls and water-quality controls and that granting the waiver for the current constructed phase does not waive future development requirements.
