Cattail Marsh developer agreement presented as informational item; unique utility ownership plan

The department presented an informational item July 9 on a proposed developer agreement with Oneida Scribe for the Cattail Marsh subdivision. Staff asked the committee to receive the item and place it on file while staff completes additional legal review.
Staff said the proposed work includes roadway, sanitary, storm and water construction for a residential development. Unlike typical agreements where the developer dedicates utilities to the city, staff said this developer intends to retain ownership of some utilities while the city would assume responsibility for road and sewer maintenance; staff said that arrangement requires additional review by the city attorney.
Committee members received and placed the informational item on file; staff indicated they will return with a draft agreement after legal review and additional information.
