The Newport News Planning Commission on Dec. 18, 2024, voted unanimously to recommend approval of special exception SE2024‑0005 to permit an enlargement of a legal nonconforming automobile dealership at 12602 Jefferson Avenue.
City planning staff said the 4.8‑acre site currently houses a Mazda dealership that has operated continuously since 1985 and predates the present zoning requirement that auto dealerships obtain a conditional‑use permit. Staff said the proposed expansion is about 1,900 square feet, will increase the overall building to a maximum of roughly 12,000 square feet, and includes a two‑story showroom area and façade improvements. Staff concluded the enlargement “is in harmony with the surrounding uses” and complies with the dimensional regulations required for an expansion of a nonconforming use. Staff recommended forwarding the request to the Board of Zoning Appeals with nine conditions, including submission of a Class 2 site plan, brick at the base of the structure, and building elevations and exterior materials and colors for review.
One speaker, Jeff Dehalo, identified himself as area market president for Southern Auto Group and spoke in favor of the application. Dehalo said that previous parking on grass at the property had been remedied and that the small expansion is required by Mazda as part of a brand refresh; he told the commission, “there’s not been any parking on the grass whatsoever since then.”
Commissioners asked for clarification that the expansion would remain within the existing premises and would not create a new use; staff affirmed the enlargement would be limited to the same premises and would not cross into a more restrictive zoning district. The commission then voted 6‑0 to recommend approval. The Board of Zoning Appeals will consider the case at its Jan. 21, 2025 meeting.
