Portsmouth staff to place Deep Creek townhouse use-permit extension on next council business agenda

Portsmouth planning staff told the City Council at its June 10 work session that a developer who has begun earthwork for a proposed townhouse project on Deep Creek Boulevard is seeking a one-year extension of a conditional use permit.
Dr. Russell, the city’s director of planning, said the city zoning rules require applicants with conditional use permits to start construction within 24 months of approval and to request an extension within 30 days before the permit expires. She said the project was approved in June 2023 and the applicant is asking to extend the permit through July 2026. “Staff is in support of that proposed action,” Dr. Russell said.
The council did not take a vote at the work session. City Manager Dr. Coleman and planning staff recommended placing the request on the next regular City Council business agenda after the city completes any required notice and advertising. Dr. Russell also told council members that she had received a late request from representatives of William and Mullins (Tyler Rosa was listed as the contact) asking to defer consideration of two other use-permit items (listed in the staff remarks as numbers 2103 and 202109) until the council’s June 24 meeting.
Applicant Ron Holloway appeared in the chamber and planning staff reported seeing some earthwork and movement of concrete on the site. Council members clarified that the work session was being used only to exchange information and not to permit public comment or to make a final decision. Mayor Glover and staff said the formal extension request will be placed on the business agenda with the usual public-notice process.
Because no formal vote or final action occurred during the work session, the council provided direction to staff to proceed with the public-notice and agenda process rather than approving or denying the extension at that meeting. The planning director and city manager said they would present the formal item at the business meeting after required notice.
Looking ahead, the planning presentation also noted that the General Assembly provided an extension for many development projects through July 1, 2025 as part of pandemic-era measures, and that the local zoning provision guiding conditional use permit timing is cited in staff materials. Council members did not take a formal vote on any use-permit application during the work session.
