Staff explained the motion responds to ownership transfers and consolidation among interests on the property. Attorney Brian Shook, representing owners, said the proposed division separates property so that Sand Street Properties, Hunters and Delvin Auto Body (named in the transcript) can finalize ownership transfers and complete a previously required building. Staff noted an existing land contract places restrictions on Lot 1 tied to a required principal structure.
The commission’s motion required that existing deed restrictions from the 2022 land contract remain in place; that the principal structure on Lot 1 be completed by Dec. 1, 2025; that any conditional use permits applicable to the lots be complied with; that the plat identify no access within 75 feet of the Ann and Seventh Street intersection per the cited standard; and that county signature and subject‑to notes be removed as revised. The motion carried on voice vote.
Planning staff said these conditions align with the city’s prior sale terms and help ensure the intended transfer of ownership and future use of the properties.
