Butte-Silver Bow to draft marijuana sales ordinance; commissioners hold request pending review

Butte-Silver Bow County Attorney Matt Enruth asked the Judiciary Committee on July 9 to authorize his office to draft an ordinance regulating the sale and distribution of medical and recreational marijuana, and commissioners voted to hold the communication in abeyance.
Enruth told the committee he had no update at the meeting and would provide one at the next Committee of the Whole, saying, "Due to the holiday week last week and the fact that my entire office and myself are in school this week, I have no updates on it. We'll provide [an update] at the next Committee of the Whole meeting." Commissioner Callahan asked whether the county could temporarily limit the number of marijuana businesses while the ordinance is finalized, asking, "we wanna put a limit on how many we can have. Is there any way we could put that in limbo until this is passed?"
Enruth replied that local action is constrained by recent state timing and a state moratorium: "So the ones that are in the works right now prior to June 30, we couldn't stop. After June 30, the state has a moratorium on them, so we don't have to do anything. So anything that was filed prior to June 30... the state will not give them the license because of the moratorium." The committee accepted a motion by Commissioner Thatcher to hold communication number 2025-310 in abeyance; the motion passed.
The item will return to a future meeting for further updates from the County Attorney's Office and additional committee consideration.
