Belton City Council approved the vacation of a utility easement located in Autumn Ridge Fourth and Autumn Ridge Fifth plats, an action staff said was necessary to allow the buyer to close on remaining lots in Autumn Ridge Fifth Plat.
City staff told the council the easement was dedicated to the city in August 2007 in anticipation of an Autumn Ridge third plat; utility companies and property owners were notified of the vacation request and staff received no objections. Staff also said there are no known utilities currently within the easement because utility companies used other rights-of-way or easements to install services for new residential development.
The planning commission held a public hearing July 1 and unanimously recommended approval. Staff asked for a second reading and prompt recordation so the buyer could proceed with scheduled property closings; the council approved the item on first and then second reading and voted to record the vacation. Staff said the vacation would enable the buyer to close on the remaining single-family lots.
No council member registered opposition during the motion and roll calls recorded unanimous approval. Staff indicated only two lots subject to the easement were not owned by the applicant and those owners were notified prior to the city hearing.
