County board delegates authority to county administrator to accept opioid settlements

The Jefferson County Board of Supervisors on July 8 approved a resolution delegating authority to the county administrator to enter into settlement agreements with defendants in the multidistrict opioid litigation, allowing the county to accept future settlement participation agreements without separate board action so long as counsel and the MDL plaintiff committee recommend the settlements.
Finance Committee materials and the resolution trace the county's involvement to an October 2017 engagement (resolution 2017-39) that authorized outside counsel to pursue claims against opioid manufacturers and distributors on Jefferson County's behalf. The litigation was consolidated in the Northern District of Ohio as MDL 2804; the county was notified of a proposed settlement with Sandoz Inc. and asked to sign a participation agreement by July 24, 2025.
Rather than bringing separate board resolutions for each proposed settlement, outside counsel recommended delegating authority to streamline acceptance if (1) the MDL plaintiff's executive committee recommends the settlement and (2) Jefferson County's share would be calculated according to the methodology used in prior settlements. The resolution authorizes the county administrator to sign such settlement agreements under those conditions; the finance committee recommended the measure and the board passed it by voice vote.
Fiscal note in the materials said the amount of future settlements is not currently known; once payments are confirmed staff will present a subsequent resolution detailing proposed uses of any funds and related budget adjustments.
Ending: The delegation is intended to speed the county's participation in a sequence of anticipated settlements; staff will return with appropriation resolutions after exact payment amounts are known.
