After the Town Council approved the interlocal agreement sending Whitestown ordinance adjudication to Zionsville on July 9, 2025, staff outlined immediate next steps: draft ordinance amendments to align Whitestown fines and fees with Zionsville’s docketing practices, finalize the mechanism for transferring collected fine proceeds from Zionsville to Whitestown, and conduct a 12-month review of the fee arrangement.
Council members and staff discussed that Whitestown's ordinance fines have not been updated consistently since the town's court ceased operations and that Zionsville’s fees reflect ongoing court operations. Staff emphasized that adoption of the interlocal agreement does not automatically change Whitestown’s ordinance fine amounts; those will be presented separately as ordinance amendments. The agreement also allows either town to terminate with 60 days' notice.
Staff estimated Zionsville would like to begin handling Whitestown ordinance matters by September and confirmed they will bring ordinance amendment proposals to council for review; councilors asked for a timeline and were told a 12-month reassessment of the financial arrangement was already planned.
