Board approves two after-the-fact four-year interim use permits for recreational vehicles

Tim Nelson presented two planning cases to the Cook County Board of Commissioners on June 24 seeking four-year interim use permits to allow recreational vehicles (RVs) for seasonal residential use while new residences are built.

Both cases were described in staff reports as after-the-fact placements for seasonal living during construction. The first—an application labeled the Hansen interim use permit—requested an interim use in the Lutzen Town Center Residential Incentive Zone District and was recommended unanimously for approval by the planning commission. The board approved the permit by voice vote.

The second case sought approval for two RVs on a property in a light industrial zone (Timothy Johnson). Nelson said the record showed the applicant had paid required after-the-fact fees; planning staff and the planning commission recommended approval with conditions. The planning record noted concern about generator noise; the county added a condition requiring a physical barrier to limit noise transmission. The board approved the permit by voice vote.

Nelson told commissioners that Minnesota law and case law require land-use decisions to be judged on their impacts rather than how they originated, which informs how the county evaluates after-the-fact requests and fees. Commissioner Sullivan told the board she supported the four-year term, noting the high cost of construction as a rationale for the longer interim period.

Both motions passed unanimously; the verbatim roll-call tallies were not recorded in the meeting transcript and were recorded as voice votes.
