Commission approves shade covers for top‑floor paddle courts; applicant wins relaxed removal condition

Community Development Director Kevin Klop told the Local Planning Agency the amendment to a prior conditional use would add shade covers over previously approved paddle courts; staff supported the change but recommended a condition that the shade covers be removed during tropical storm or hurricane warnings. The applicant sought an adjustment to that requirement, arguing the product is engineered to withstand winds in excess of 100 miles per hour and asking that the condition require removal only during a hurricane warning, not a tropical storm warning.
Mickey Marrero, attorney for the applicant, asked that the community development director be authorized to accept documentation showing the product rating and to limit the removal requirement to hurricane warnings. Commissioner Brown amended the motion on the record to accept that condition; the motion passed without public objection.
The Local Planning Agency recommended approval and the City Commission adopted the resolution on second reading with the amended condition. The resolution cites the city code provision that governs conditional uses in the Town Center zoning (section 31‑1.45(b)(3)(m)).
The approval allows the courts and shade structures to proceed subject to the condition that the applicant demonstrate, to the community development director’s satisfaction, that the coverings can withstand design wind speeds and that the removal requirement will apply only for hurricane warnings if that documentation is provided.
