Commission approves petition to vacate portion of roadway in Shadowbrook Estates

The Franklin County Commission voted to approve a petition to vacate a portion of a platted roadway in Shadowbrook Estates during its meeting. Commissioners moved, seconded and carried a voice vote to grant the petition under commission order 2025-170.

The petitioners' representative told the commission, "I am here, your honors, on behalf of the petitioners for the vacation of the road in Shadowbrook Estates." He said the petition concerned only a portion of the road, that the county had posted notices and that adjoining property owners had joined the petition. "It's only a portion of a roadway. We've sent out the appropriate notices, posted the appropriate notices," the representative said.

Commissioners confirmed there was no one present to oppose the vacation and asked whether the action would landlock any property. One commissioner asked directly, "That doesn't landlock anybody back in that?" A commissioner confirmed no landlocking, noting the property owner to the south is "Mr. Heimer" and that other parcels have access to a state highway. The commission noted the adjacent property owners contiguous to the road had joined the petition and that access to a nearby cemetery would not be cut off; the representative confirmed cemetery access is from Highway T.
