Homewood City staff told the Finance Committee on June 30 that a refund petition from Daxko (referred to in presentation as the Daxko request) is pending and that staff will bring a resolution to the full council for action.
Staff said Daxko filed a refund petition for $207,000 with the city's licensing authority (referred to as Beau in the presentation); Rivertree's audit concluded Daxko is entitled to a refund of approximately $105,000 and recommended denying the remainder. Staff said they will prepare a resolution for the council meeting to authorize the lesser refund amount and to authorize defense against any further claims. The committee agreed to include the matter as "other new business" on the July 14 council agenda so the full council can consider the resolution and related audit documents.
City staff said Wayne Morris in the city attorney's office is assisting, and staff will circulate the Rivertree audit to committee and council members prior to the council meeting for review. No formal committee action beyond scheduling the matter for council consideration was taken at the finance committee meeting.
