Clerk Blunt summarized outstanding compliance items including a citation to city code: "city code of ordinance chapter 14 alcohol section 14 80 nonoperation." The City Attorney told the council the applicant ttorney had reached out to indicate the business had met the hours threshold for the covered license period, but the City Attorney recommended postponing final action to allow the council and staff time to review documentation and clarify legal questions.
Councilor Johnson asked, "Just, real quick on their compliance, this would mean that they do not have an active license. Is that correct?" The City Attorney replied, "I would consider them to be unlicensed right now. And in fact, I will reiterate that to their attorney for what it's worth." The City Attorney also said, "As soon as this meeting adjourns, I will communicate with their attorney."
Councilors voted by voice to postpone the renewal to the next regular meeting; the motion carried. The postponement leaves Center Folds without an active license pending the council ction and any additional documentation the applicant submits. The City Attorney advised councilors to consult privately with legal staff if they have questions about potential liability or other legal issues before the next meeting.
