Sanford Waterloop construction award recommended but contract action postponed pending developer funding

The Madison County Board of Commissioners reviewed sealed bids on June 30 for the Sanford Waterloop project and heard staff and the engineer recommend awarding the construction contract to Vintage Soul LLC.
County staff reported that five sealed bids were received; Vintage Soul submitted the low bid and that staff and the project engineer performed reference and licensing checks and reviewed the contractor's equipment and qualifications. Separately, staff solicited three quotes for materials; the recommended material vendor was the lowest of those three. The project funding is provided in full by the Rose development under an existing agreement: Rose will deposit project funds with the county before work begins, will be invoiced for any overage and will be refunded any under-run, the county said.
Several commissioners asked whether the board's award would also commit the county to begin a contract clock before funds are received. Staff said the project cannot begin until the Rose development transfers the required funds and recommended making contract approval contingent on receipt of those funds and on finalized contract language setting the payment and timeline conditions. Commissioners discussed whether to approve an award now and the formal contract later; the board voted to postpone final contract approval until contract language can be finalized and receipt of the Rose funds is confirmed.
Staff indicated they will return the construction contract and the Rose funding agreement to the next meeting after adding contingent-payment language and timeframes so the county does not start a contract timeline before funds have been received.
