Letcher County fiscal court affirms low bids, orders rebid and sets fallback for larger culverts

Court members approved low bids read into the record by county road staff: B and D Construction for $26,938 (project 741947); Ester and Company for $16,780 (project 741952); CNC Construction for $36,017 (project 742956); and Ester and Company for $7,461 (project 742988). A roll-call vote followed and the motion passed.
The court spent an extended discussion on how its bid documents priced culvert work in 20-linear-foot units. Several contractors and commissioners said some culvert installations require 30- or 40-foot pipes, deeper excavation or additional drilling, which can substantially raise the contractor’s cost. County road staff said the bid line unit was deliberately written by linear 20-foot beds to unify pricing, but that the difference in complexity between sites creates uncertainty for bidders.
After trading views, the court directed staff to rebid culvert work with clarified language on lengths and unit pricing. In the interim the court agreed to a fallback process: if the low bidder refuses a particular job because the culvert or site conditions make the work larger than the quoted 20-foot unit, staff may offer that job to the second bidder at the same unit-based terms rather than stopping work. The court also authorized staff to allow reasonable linear-foot adjustments for projects that require longer pipe runs, leaving final on-site determinations and the option to decline to the contractor.
County staff said they will rebid the group of culvert line items for the next meeting with clarified specifications and will bring 20-plus additional road projects to award at the next session from the recent disaster-recovery list. Commissioners emphasized the need for clearer bid language and for pre-bid site checks to reduce repeat rebids.
Court members also asked staff to prioritize the worst road segments for procurement and reported that some sites require deeper excavation or have utilities in the way, which can change installation methods and costs. The court instructed staff to return with the rebid and clarified process at the next meeting.
