Council approves vacation of undeveloped alley to allow access for single-family build at 316 Hammock Street

Staunton City Council adopted an ordinance on June 26 to vacate a portion of an unaccepted alley between several Peck Street properties so applicant Max Núñez can access a landlocked parcel and construct one single-family home at 316 Hammock Street.
Nut graf: Planning and staff review found the alley was platted but undeveloped, not being used by adjoining owners, and that vacating the eastern portion would allow a private easement to reach the landlocked lot; the planning commission had unanimously recommended approval in March 2023.
City staff explained that the property was annexed in 1905, the alley was platted in 1917, and the applicant bought adjoining property in 2023. Because extending Hamrick Street solely to serve one house would be cost-prohibitive, the applicant proposed a private easement over a Peck Street lot he also owns. Staff said they had received no written opposition and that vacating the alley would not affect usability of other alleys.
Applicant Max Núñez addressed council briefly, saying the vacation would allow him to build with reasonable access: “I would just really like to, if we can use this to build a single family house in the back… and get that access without being super costly,” he said.
Councilor Overholtzer moved and the council voted by roll call to adopt the ordinance as recommended by the planning commission. Roll call recorded all six members present voting aye. The ordinance finalizes the alley vacation and enables the applicant to proceed with required easements and platting.
Ending: Council closed the public hearing after no members of the public asked to speak; staff will process the ordinance and related easement and plat documents so the applicant can move forward.
