BEXLEY — The City Council on third reading adopted Ordinance 14-25 authorizing the mayor and auditor to sign a consent-and-hold-harmless agreement with the property owner at 240 South Drexel for improvements made in the city-owned right-of-way between the sidewalk and property line.
Councilmember Marcelino moved to adopt Ordinance 14-25 and a second was recorded by Councilmember Hurley. No public comments were offered on the ordinance at third reading, and the council took a roll-call vote to adopt the ordinance.
Mayor and staff noted the work on the property originally had been unplanned by the city; staff described the new wall as less intrusive than the previous wall and said it may effectively serve as a curb in the right of way. The mayor added that the wall had not been extended further when the issue was first identified and characterized the consent-and-hold-harmless as a precautionary measure.
Councilmembers said they had driven by the property and believed the current work did not encroach further into the right-of-way. The mayor and planning staff said they were comfortable moving forward with the consent-and-hold-harmless agreement as a precaution.
The ordinance gives the city the authority to sign the agreement with the property owner and completes the council action required for the administrative processing of the property’s right-of-way work.
