Dan Lewis, attorney for the board, told the Punta Gorda Code Enforcement Board on June 25 that the board’s earlier order in the Emerald Landing matter will not be pursued further: the city and the appellant have agreed to dismiss the appeal, city council approved dismissal, and each side will bear its own legal fees.
Lewis said part of the rationale was a factual issue in the appeal record: although the appeal alleged street‑light violations, inspectors and staff concluded there are no street lights in Emerald Landing. He said the practical responsibility for the lampposts, per homeowners‑association documents, rests with the homeowners. Lewis reported that during a drive‑through he observed two leaning lampposts in disrepair and that the electricity feeding the posts runs from individual homes to the posts.
Chairperson Adele Higgins asked for timing and history; Lewis said the matter dated back roughly two years. The update concluded with Lewis advising the board that dismissal avoids the risk of the city incurring significant legal exposure and that the parties agreed each will pay their own fees.
The board received the update as an informational item; no further board action was taken at the meeting.
