DNR approves exchange of 1 acre for 6.7 acres in Flambeau River State Forest to resolve trespass

The Natural Resources Board approved a land exchange in the Flambeau River State Forest (Sawyer County) on June 25, 2025, that transfers an acre of department-owned land containing a private residence to the Lutch family in exchange for 6.7 acres of undeveloped forest and wetland.
Terry Bay, Facilities and Lands Bureau director, told the board the privately owned improvements (house, well and septic) were built without a survey on land later found to lie on department property. To resolve the trespass, the department negotiated a land exchange: the department conveyed the developed 1-acre parcel and acquired 6.7 acres that abut existing state forest to the north and west. Certified survey maps comply with Sawyer County zoning, and a noticed public hearing on February 21, 2025, drew no attendees for or against the transfer.
Bay said the 6.7-acre parcel has 355 feet of public road frontage and will be open to the public for nature-based recreation. The board found the 1-acre parcel was no longer needed for conservation purposes and approved the exchange by motion.
Board members said the acreage to be acquired appeared to be high-quality forest/wetland habitat and noted the department gained more land for the state forest under the exchange.
