Westfield amends CNE Farms development agreement to move required entrance and reimburse Westwood wedding venue

The Westfield Board of Public Works and Safety approved an amendment to a prior development agreement for the CNE Farms (Spring Mill/186th area) project that relocates a previously required full-access entrance on Sundown Gardens property to a new entrance to be built at the Westwood wedding venue to the south.
"The original agreement ... required a full-access entrance approximately in this location for full access for this parcel," Michael Pierce, city engineer, said while showing GIS exhibits. Pierce said Westwood Wedding Venue proposed moving the entrance south, which the city prefers because it places access further from a nearby roundabout.
Pierce described the amendment as a reimbursement arrangement: "What we're essentially doing through this agreement is paying for their entrance that they would be building down here on the South. And so this would, essentially serve as a reimbursement to them for that cost. That way, we don't own the contract on it. They will build it." He added the city will agree on an estimate before reimbursing the venue.
The change replaces an earlier plan that would have put a curb cut and full access on the Sundown parcel; the amendment reduces the number of curb cuts and shifts required access to the privately built entrance. Board members said Sundown Gardens had been cooperative.
Caitlin, legal staff, and Pierce indicated they had reviewed the amendment and felt comfortable presenting it for approval. A motion to approve the Sundown Gardens amendment was made, seconded and carried by voice vote.
Pierce said this amendment satisfies one of the remaining items from the original development agreement related to the Sundown parcel. He noted the private entrance could in the future include a private ride-in/ride-out if the property develops further, but any such private improvement would be privately constructed and maintained unless otherwise agreed.
The board approved the amendment and directed staff to finalize the agreement language and reimbursement estimate before payment.
