Board continues then approves gazebo setback variance after neighbors clarify concerns

The Seminole County Board of Adjustment heard a request from Mount Zion Baptist Church for two side-yard setback variances for a gazebo constructed on the church property. The item was briefly continued so staff could clarify how the proposed structure related to adjacent parcels; after the applicant and neighbors discussed the matter, the board approved the variances.

Cathy Hamill of Development Services presented the item, explaining the church had constructed the gazebo without a permit and received a code-violation notice; the request sought a west-side setback reduction from 50 feet to 42.5 feet and an east-side reduction from 10 feet to 6.5 feet. The applicant, speaking for the church, said the gazebo is used for community services including feeding people in need and distributing clothing.

Some neighbors initially listed the request as in opposition and told the board they had received unclear information about the effect on their properties. Sharon Stevens and Gloria Johnson said they were concerned the gazebo might affect their lots and future saleability; both said they had not received clear, consistent information before the meeting.

Staff and the applicant explained the variance applies only to the church parcel and will not remove or change neighboring property rights. After staff clarified the specifics and the applicant confirmed he had asked fellow church members for letters of support, the neighbors told the board their concerns were addressed and withdrew opposition.

With neighbors’ concerns resolved, a motion to approve the variances was made and seconded; the board voted in favor. The chair and staff reminded the applicant that permits and any required inspections remain necessary and that staff would work with the church to ensure permit compliance moving forward.
