City planner told the council the overlay is a zone map amendment intended "to focus on, design and elements and standards to define the look and feel of future developments in the riverfront," and that the standards will help fulfill goals in the city’s 2017 comprehensive plan and the 2016 riverfront feasibility study. The planning commission reviewed the proposal and forwarded it to council; staff recommended approval on first review.
The public hearing was opened and the council asked three times for persons wishing to speak in favor or opposition; no members of the public spoke for or against the overlay. After closing the hearing the council moved to approve Ordinance No. 8-24 on first reading, an ordinance amending the official zoning map (Ordinance 3-12) to apply the Downtown Riverfront Design Overlay District to certain lots in the Riverfront corridor.
The overlay language, according to staff, is intended to define design elements and development standards for the riverfront corridor; staff said the overlay also implements goals from the city’s adopted planning documents. The ordinance was approved on first reading by voice vote; the record shows the motion passed on first reading. The ordinance text amends the official zoning map adopted June 1, 1981, and applies the overlay to identified parcels within the riverfront corridor.
Council and staff noted the hearing was conducted "in accordance with state statutes, Mills' council procedures, and other applicable laws," and that the hearing had been advertised as required. The council did not receive public testimony on the ordinance during the hearing.
Because the council approved the ordinance on first reading, additional readings and formal adoption procedures remain before the overlay becomes final and effective.
