KIEL, Wis. — The Kiel City Council on June 10 approved a seasonal outdoor-music permit for Edgewater Bar and Grill, allowing the business to host bands during the summer season so long as performances end by 11 p.m. and the establishment complies with city ordinances.
City staff explained the permit followed complaints to the police department about music continuing past 11 p.m. Staff told the council that the owners had been advised previously — incorrectly, the staff said — that no permit was necessary if music stopped at 11 p.m. Staff and the police chief met with the owners, reviewed permit requirements and helped the business complete an application that covers the entire season rather than single weekends.
"They will comply with all ordinances," a city staff member said, summarizing the owners' written pledge and the permit conditions. Staff also reported that the property had fencing required by the permit and had provided the required insurance declaration. The staff presentation said the owners had taken steps to reduce sound transmission, including directing indoor DJ speakers so they no longer projected outside.
Staff reported that there were no recent parking complaints and that the outdoor area was limited in size; staff said the outside area "maxes out at 99." The staff presentation also noted that city personnel checked sound levels on a recent weekend and heard no further complaints.
Council discussion emphasized that the permit is the first of its type in many years and that staff had worked with the owners to reach conditions acceptable to the city. A motion to approve the permit was made and the council recorded a unanimous vote in favor. The council did not add other limitations beyond those in the permit as presented.
The permit as granted covers the summer season; staff said it avoids requiring a separate permit for each weekend, which they described as unnecessary administrative burden.
