Montgomery council denies special-use permit for drive-through restaurant at 21049 Eva Street

The City of Montgomery City Council voted 4-1 on June 24 to deny a special-use permit for a proposed fast-food restaurant with drive-through service at 21049 Eva Street.
At a public hearing, several residents told the council they opposed the location because of traffic and neighborhood aesthetics concerns. One resident said, “I am opposed to this fast food restaurant at this location,” and another stated, “I love Jack in the Box, but not at that location.” Speakers pointed to possible congestion during school drop-off and pickup at nearby Montgomery High School and an elementary school as a reason for concern.
Council members noted the applicant had not provided a traffic impact analysis. Staff told the council that Planning and Zoning had not supplied additional information after a June 3 review and that no traffic study had been received. Councilmembers said the lack of that analysis and the negative public response weighed on their decision.
The roll call on the motion to deny was recorded as: Place 1 (Miss Langley) — No; Place 2 (Mr. Olsen) — Yes; Place 3 (Mr. Zulevich) — No; Place 4 (Miss Fox) — No; Place 5 (Mr. Donaldson) — No. The council chair announced the motion carried and that the permit was denied.
The council did not adopt any alternate conditions or direct staff to return with a mitigation plan; the action taken was a denial of the permit as presented.
