City Attorney Celestine told the council that earlier condemnation steps required re‑notice because the written finding of facts had not been mailed after the city located potential additional heirs. At the meeting, Thomas Gagliano identified himself as an heir and said he was seeking legal help to probate the will and, if possible, take title. Gagliano told council, “If y'all could give me a little bit more time, I'm looking to clear the property, put it up for sale,” and asked for leeway to arrange legal counsel and begin cleanup.
The council agreed to defer further action and voted to continue the matter to the July 22 council meeting to give Gagliano time to pursue probate and title. City staff said that if the property cannot be placed in an owner’s name within the deferral period, the city may proceed with condemnation and place a lien on the property as allowed under city procedure.
The deferral preserves the city’s ability to proceed later while ensuring people with potential legal interest receive notice and the opportunity to act. Staff asked the potential heir to stay in contact with the city attorney to confirm steps and timelines for probate.
