A county official summarized that the original arrangement — a 30‑month closure tied to leases with local landowners and REO — began in February 2022 and that the mine took six months to close the road. The company has since lost a customer and asked for the full 30‑month closure period; the county’s proposed extension would let them have the remainder of the 30 months provided certain conditions are met.
Under the new agreement described at the meeting the operator must deposit additional money into the county’s escrow account, increase the bond amount to cover potential road restoration costs, construct a run‑around road by Dec. 2025 so traffic can pass if needed, prepay resurfacing of 500 East and pay any legal costs the county incurs to re‑draft or enforce the deal. County staff also said the agreement includes month‑by‑month penalties if the road is not restored on schedule.
The county identified June 28 as the current expiration date of the existing deal and asked commissioners to approve an extension that would be executed only after the county engineer, Chris, confirms an appropriate bond amount to cover restoration. The board approved the extension pending that confirmation; Commissioner Keith moved the motion and it passed 2‑0.
The county staff member said they would work with the operator and county engineer to finalize the bond figure and return executed documents if the engineer is satisfied. Staff will monitor the run‑around construction and the escrow funding schedule and enforce monthly penalties for noncompliance if necessary.
