Commission approves expansion of topsoil extraction site on Peru Creek Road with conditions

The Planning and Zoning Commission voted to amend an existing conditional use permit to expand a topsoil extraction operation on Peru Creek Road from about 41.53 acres to approximately 127.06 acres.
County staff said the original CUP (CUP 631) from 2004 allowed topsoil extraction in a defined area and that the amendment does not change the nature of the operation, only its footprint. Staff reviewed environmental and floodplain considerations and recommended five conditions in addition to the original CUP conditions, including limits on extraction areas and setbacks shown on the concept plan, preserving the areas marked as existing trees, washing trucks before they exit the property to avoid tracking mud onto public roads, limiting hours of operation to 7 a.m. to 7 p.m., and requiring that the conditional use not become active until all conditions are met.
Applicant Michael Steiniger said the business has operated since 2004 and serves local landscapers and road contractors. He said the proposed expansion covers additional ground the business has farmed and uses in current operations and that he is amenable to the proposed covenant restrictions.
Arnie C. Dinoff, county public advocate, supported approval but urged strict adherence to state and county stormwater and erosion controls and recommended a reclamation or restoration plan for the site after extraction. The commission approved the amendment with the conditions recommended by staff; the conditional use will not become active until the conditions are met and required permits (including any floodplain permits) are obtained.
