The Alpharetta City Council voted unanimously June 23 to authorize the city attorney to exercise eminent domain powers to acquire interests in Parcel 12 of the Old Milton Parkway project so the city can meet a Georgia Department of Transportation (GDOT) right‑of‑way certification deadline.
City staff told council the action covers 0.004 acres of fee‑simple right of way with “just inadequate compensation” of $5,200. City staff said there was a closing earlier in the project but a subsequent title gap was discovered after property ownership changed hands; the city said it is working with the owners and hopes to avoid filing a condemnation action.
“Because this is a GDOT funded project, we have to certify the right of way to GDOT by next Monday on the thirtieth,” the staff member who read the resolution told council. That timeline, staff said, is why the resolution was brought now even as negotiations continue with the property owners.
Mayor Pro Tem Markel moved to approve the resolution; Councilman Mitchell seconded. The motion passed unanimously.
The resolution authorizes condemnation only for the narrow interest described by staff and does not include purchase of construction work or any separate approvals for construction funding. Council members did not direct immediate construction; staff said a separate process will follow if condemnation becomes necessary.
Council adjourned after completing the item.
