Peoria County approves four subdivision-waiver requests for rural parcels and estate settlement

Peoria County approved four waiver requests to the Unified Development Ordinance that will permit creation or reconfiguration of rural parcels despite standard public-water or road‑frontage requirements.
All four petitions passed unanimously after staff presentations and brief board discussion. Staff recommended approval in every case; some approvals included conditions such as perpetual easement restrictions and address/signage requirements tied to comments from the county highway department and emergency‑services dispatcher (ETSB).
The four cases were:
• WAV-2025-0003 (4 J Farms LLC): Waiver of UDO section 20-8.3.4.1.b.28, which requires a new minor subdivision to have access to a public water supply. The proposal would divide a 2-acre tract from a 172.44-acre parcel on West Route 150 (Section 34, Jubilee Township) to allow construction of a single-family dwelling. Public water is about 5.5 miles east; a new well on the lot produces 5 gallons per minute, which exceeds the UDO requirement of 3 gpm. Staff recommended approval.
• WAV-2025-0004 (4 G Farms LLC): Waiver of UDO section 20-3.16.3.2.b.1, which requires a minimum of 30 feet of public road frontage for minor subdivisions under 10 acres. The proposed 2-acre tract would be accessed via an existing private driveway with approximately 8 feet of public frontage plus a recorded 12-foot right-of-way, yielding about 20 feet of access. The parcel is adjacent to Jubilee College State Park; staff recommended approval with restrictions addressing additional easements and address signage per Highway Department and ETSB comments.
• WAV-2025-0005 (Michael P. Cochran): Waiver of UDO section 20-3.16.2.3.b.2.b, which requires a minimum of 60 feet of public road frontage for parcels created by tract survey of 10 acres or more. The petitioner proposes dividing roughly 33.02 acres from a 134.999-acre parcel to settle an estate. The proposed land will be accessed by a new 30-foot easement from the existing private driveway off North Thousand Dollar Road. Staff recommended approval with a perpetual easement restriction.
• WAV-2025-0006 (Michael P. Cochran): Separate waiver on the same overall parcel to reconfigure three existing parcels (16.97 acres; 134.999 acres with a dwelling; and 5.12 acres) into 25.38 acres, 7.52 acres (with the dwelling), and 92.22 acres. The petitioner proposes extension of an existing 60-foot easement for access; staff recommended approval with a perpetual easement restriction.
Board members asked clarifying questions about ownership, access, and the hunting/recreational use of some tracts. With no public objections recorded during the meeting, each waiver passed by unanimous vote.
