Supervisor Panico moved the meeting into executive session to provide advice and counsel to the town's attorneys who were in court on a pending matter; the motion was seconded by Councilor MacGarcio and carried on a voice vote.

Panico told the board the executive session would be brief — “no more than 5 or 7 minutes” — and asked for a second. After a second was given, the clerk called the voice vote. The record shows all in favor and the motion carried.

The board recessed into executive session and later resumed public session to proceed with the resolution agenda.
