Planning staff explained the 1.31‑acre lot had been formed by combining two previously separate lots, each with its own curb cut. Because combining lots triggers current code compliance (which generally limits lots to a single driveway curb cut separated by 300 feet from any other curb opening on the same lot), the owner requested an exception under Unified Development Code subsection 2.5.6.b to preserve both curb cuts and create a circular driveway to improve ingress/egress and safety on the busy Rucker Road corridor.
Staff noted exceptions use criteria similar to variances and that the request would not be detrimental to the public; staff also cited prior similar approvals on other properties. The applicant and builder said the site experiences high traffic volumes, that reuse of the existing curb cuts avoids rebuilding aprons and preserves on‑site stormwater and circulation design, and that a single curb configuration would not provide adequate internal circulation without additional impervious area.
Owner Paula Jansen (present via representatives) and builder Michael Lawson said the curb cuts and sidewalks are in good condition and that the circular driveway supports safer turning movements and delivery access. The applicant reported they sent required notices and received no adjacent objections.
Staff recommended and the panel approved the exception subject to a condition tying the approval to the submitted survey (Crescent View Engineering LLC, revised 04/18/2025). The transcript records the motion and unanimous approval.
