After extended discussion about public notice, safety and code scope, the Alpine City Planning Commission recommended adding a definition for "adjacent lot" to the Alpine Development Code and clarified that, for noticing purposes, lots across a public right-of-way should be treated as adjacent.
City planner Ryan Robinson told the commission staff had found no existing definition for "adjacent lot" in the code and that the term appears in multiple sections (noticing, off-street parking, lighting). Robinson said staff reviewed definitions used by other cities and proposed language to remove uncertainty about who must receive notices.
Commissioners debated the breadth of the term. Some members worried that including lots across a public street could create safety or circulation pressure—examples mentioned included weddings and businesses that draw parking across streets. Others said that for noticing and lighting it is appropriate to treat lots across the street as adjacent so neighbors likely to be affected receive notice. Commissioners observed that even if a lot qualifies as "adjacent" under the definition, staff and the commission retain discretionary standards (for example, safety or traffic circulation) that could be used to deny applications.
After several motions and an initial failed vote (the commission sought wording adjustments to address concerns), the commission adopted revised language. The motion that carried recommended approval of the code amendment to Section 3.01.110 (Definitions) to add: "adjacent lot: a lot or parcel of land that shares all or part of a common lot line or boundary with another lot or parcel of land; for noticing purposes, lots across the public right-of-way should be considered adjacent." Troy Slade seconded the motion; the vote was unanimous among those present.
The commission noted the amendment is primarily intended to clarify noticing responsibilities; staff said that other code provisions (for example, safety-based standards in off-street parking and lighting rules) still provide a basis to deny or modify proposals where public safety or circulation are concerns. The commission’s recommendation will be forwarded to City Council for final approval.
